A COSTLY CIGAR

Yesterday afternoon the police took into custody Chas. Smith, a brakeman on the Chicago, Milwaukee & St. Paul railroad, charged with assault with a dangerous weapon on Jacob Ehrmentrout. The alleged assault took place on the Fourth of July, on a train running between this city and Minmeapolis. On the day named Ehrmentrout was a passenger on the Milwaukee short line, and he got into a dispute with the brakeman regarding the privilege of smoking on the train. He was engaged in smoking a cigar when the brakeman ordered him to stop, whereupon a discussion arose. The dispute led to blows and during the melee Smith picked up a poker and struck his opponent, the blow having such force as to break his nose. Ehrmantrout recovered sufficiently to report the affair yesterday, when Smith was put under arrest. He was before Judge Burr in the afternoon and gave bonds in the sum of $750 for his appearance. The case comes up to-morrow.
