Not Murderers. The preliminary examination of Nelson Haines, Chester Haines, Peter Peterson and Otto Gutteberg, the parties who were charged with having caused the death of Gustiv Haisted by brutally pounding him, in Medina township, on May 7, was held in the municipal court before Judge Mahony Wednesday afternoon. Several witnesses were produced, the most important of whom was James W. Barnes, Haisted's employer. He testified that he had been with the crowd during the time that the boxing occurred, and was positive that Hains had taken no part in the matter, and was not molested by either of the defendants. Hains, he said, had complained on Monday, the 8th, of having a pain in his left arm, which was caused by part of a needle which had been broken off in it two years ago. After the taking of further testimony, the defendants were placed on the stand. They disclaimed having had any trouble whatever with the deceased, having merely met him by accident on the Sunday mentioned. In view of the testimony offered, County attorney Woolley made a motion to dismiss the case, and the defendants were discharged. |
